India’s treaty with Bangladesh, the political nature of the charges and the need for a court-led process leave New Delhi with no immediate duty to act on Dhaka’s request.

Hasina has been living in India since she fled Bangladesh on August 5 last year in the face of the massive protests. She was earlier declared a fugitive by the court.

Sibal stressed that the India–Bangladesh extradition treaty contains a political-offence exception, under which Hasina’s case is clearly protected.
